What CFR-1 is and why it’s needed

CFR-1 is the official application form for a certificate confirming your place of residence or registered office for tax purposes. The certificate itself (residency certificate) confirms that an individual or company has a place of residence or registered office in Poland for tax purposes. The document is needed, among other things, for:

  • applying double taxation treaties with another country;
  • confirming resident status to reclaim overpaid tax shown on an IFT-1/IFT-1R;
  • settling accounts with foreign counterparties, when you need to confirm where income is taxed.

Conditions for obtaining resident status

To obtain Polish tax residency status, it’s enough to meet one of two conditions: having a center of personal or business interests in Poland, or staying in Poland for more than 183 days during the tax year. Meeting just one of these conditions already gives grounds to apply for resident status, and consequently, to obtain a CFR-1.

A center of personal interests in practice means the place where the taxpayer’s family lives (spouse, children), where their permanent residence is located, and where they conduct their everyday social life. A center of business interests is the place where income-generating activity is carried out, the source of main income, the location of investments, movable and immovable assets, and the place from which assets are managed.

Dual residency and the risk of double taxation

It sometimes happens that a person meets the residency criteria of two countries at once, for example having a center of vital interests in Poland while also staying more than 183 days in another country with similar rules. In such a case we speak of dual tax residency, and which country has priority in taxing a given income is settled by the double taxation treaty (DTT) between Poland and the other country.

Most DTTs are based on the so-called tie-breaker rules from the OECD Model Convention, which in order consider: permanent home, center of vital interests, habitual abode, and finally nationality. The CFR-1 certificate is precisely the document that lets you prove to the other party (a foreign tax authority, a counterparty, or a remitter) that Poland is your country of tax residence for a given period.

If you suspect you may be subject to dual tax residency (e.g. you live in Poland but haven’t formally deregistered from your previous country of residence), it’s worth consulting a tax advisor before filing a CFR-1 application, since incorrectly determining residency can lead to the same income being taxed twice.

The simplest way is to use the WN-CFR service on the e-Urząd Skarbowy portal: select the “Wnioski” (Applications) section, fill in your details (these may auto-fill after logging in), indicate the country for which the certificate is needed, the period, the purpose of issue, and the collection method. For companies and sole proprietors, filing through a proxy under a general power of attorney (e.g. a tax advisor) is also available.

If you choose the paper CFR-1 form, it’s important to download the current version from the Ministry of Finance website (podatki.gov.pl), since outdated versions may not be accepted.

What documents and data you need to prepare

The CFR-1 form itself is relatively short, but you need specific data ready so the application is processed without requests for clarification. The most important elements include:

  • the applicant’s identification data: PESEL or NIP, first and last name or company name, place of residence or registered office in Poland;
  • the country for which the certificate is needed (e.g. when a foreign counterparty or tax authority requires proof of residency);
  • the period the certificate should cover, usually a tax year or part of it;
  • the purpose of issuing the certificate, e.g. applying a double taxation treaty, settling with a foreign remitter, reclaiming tax shown on an IFT;
  • if filing through a proxy, the power of attorney document along with proof of payment of the stamp duty for the power of attorney (PLN 17, unless the power of attorney is exempt from the fee).

It’s worth preparing this information before starting to fill in the electronic application in e-Urząd Skarbowy, since the session may time out after too long a period of inactivity, and some data still needs to be entered manually despite the auto-filled profile.

Deadlines, cost, and validity period

The tax office is required to process the application within 7 days of filing and issue either the certificate or a refusal decision regarding the requested certificate content. The certificate is usually valid for 12 months from the date of issue, unless the document itself specifies a different validity period. Once that period expires, a new application must be filed.

Applications filed through e-Urząd Skarbowy are free. Paper applications or those filed through e-PUAP require a stamp duty payment of PLN 17, which can be paid online in e-Urząd Skarbowy, in the eUS app, or to the account of the relevant municipality.

The most common filing mistakes

The first common mistake is imprecisely specifying the period the certificate should cover, resulting in a document covering a different time range than needed for settling with a foreign counterparty or tax authority, which then requires filing another application.

The second mistake is using an outdated paper CFR-1 form downloaded from a random website instead of the official source (podatki.gov.pl), which can result in the tax office refusing to accept the application.

The third mistake is inconsistency between the data shown on the application and the data registered in CEIDG or the National Court Register (KRS) (e.g. a different business address), which extends the procedure through an additional request for clarification.

The fourth mistake is filing the application too late, for example right before a settlement deadline with a foreign counterparty, without accounting for the 7-day processing time and any additional time needed for delivery of the document.
