When you register a sole proprietorship (jednoosobowa działalność gospodarcza, JDG) in Poland, you have to choose a personal income tax (PIT) method. That choice affects not just the tax rate, but also your monthly health insurance contribution (składka zdrowotna), a detail that’s often mixed up in older guides. The four tax methods available to a JDG
Poland offers (or, in one case, used to offer) four PIT methods for sole traders:
- zasady ogólne: general rules, a progressive scale of 12%/32%;
- podatek liniowy: flat tax, a fixed 19% rate;
- ryczałt od przychodów ewidencjonowanych: a lump-sum tax on revenue, with industry-specific rates from 2% to 17%;
- karta podatkowa: a fixed tax-card amount, closed to new taxpayers since 2022.
You declare your method in fields 18-19 of the CEIDG-1 registration form. If you don’t select one, general rules apply by default.
General rules: the progressive tax scale
Under general rules, tax is calculated on income (revenue minus deductible business costs). The 2026 scale is unchanged since 2022:
- income up to PLN 120,000 a year: taxed at 12%, with a tax-free amount (kwota wolna od podatku) of PLN 30,000 (applied through a PLN 3,600 tax-reducing amount);
- income above PLN 120,000: PLN 10,800 plus 32% of the excess.
This is the only method that allows joint filing with a spouse and access to most family-related reliefs (child relief, rehabilitation relief, etc.).
Health contribution (składka zdrowotna) under general rules is 9% of income, with a 2026 minimum contribution of PLN 314.96 for January and PLN 432.54 from February 2026 through January 2027 (the minimum is tied to the minimum wage). The contribution cannot reduce your tax base, one of the key differences from the flat tax.
Flat tax (podatek liniowy)
The flat tax is a fixed 19% rate on income, regardless of the amount earned in the year. It comes with two important trade-offs:
- no tax-free amount: the 19% applies from the first zloty of income;
- no joint filing with a spouse, and no access to most family reliefs.
As with general rules, you can deduct business costs to reduce the tax base.
Health contribution: 4.9% of income, with the same PLN 432.54 minimum (from February 2026). One important nuance: on the flat tax, you can deduct part of the paid health contribution from your tax base, up to an annual cap of PLN 14,100 (PLN 1,175/month). General rules don’t offer this deduction at all.
Lump-sum tax on registered revenue (ryczałt)
Ryczałt is the most popular method among IT specialists and freelancers with low business expenses. The key feature: tax is charged on gross revenue, not profit, business costs aren’t deducted at all. The rate depends on the PKWiU classification code of the specific service you provide, not your job title or PKD code.
Current 2026 rates for the activities most relevant to our clients:
- 12%: software-related services: programming, developing and creating software, IT consulting, managing IT systems and networks;
- 8.5%: “other” services that don’t fall under a higher rate: technical support without an advisory element, testing without recommendations, configuring systems according to existing documentation;
- 15%: consulting services (including management consulting), wholesale trade brokerage, reproduction of recorded computer media;
- 3%: retail and wholesale trade, catering;
- 17%: “free professions” in the narrow legal sense (translators, attorneys, physicians, etc.).
The line between 8.5% and 12% for IT work is a common source of disputes with the tax office: what matters is the actual nature of the tasks performed, not the job title “programmer.” If you’re unsure which rate applies to your services, check the specific PKWiU code or consider requesting an individual tax ruling.
Ryczałt is only available while the previous year’s revenue is below EUR 2 million.
Health contribution on ryczałt doesn’t depend on your ryczałt rate or your profit at all, only on annual revenue, in three fixed brackets (2026 figures, based on average monthly wage for Q4 2025, PLN 9,228.64):
| Annual revenue | Monthly contribution (2026) |
|---|---|
| up to PLN 60,000 | PLN 498.35 |
| PLN 60,000-300,000 | PLN 830.58 |
| above PLN 300,000 | PLN 1,495.04 |
You can deduct 50% of the paid health contribution from the ryczałt tax base.
Tax card (karta podatkowa)
Many older guides still list the tax card as an available option: that’s outdated. Since January 1, 2022 (the Polski Ład reform), the tax card has been closed to new taxpayers. It’s only available if you:
- were already using it on December 31, 2021;
- haven’t opted out since then;
- haven’t lost your right to it (e.g., by expanding your activity beyond the eligible list, or exceeding the employee-count limits).
The tax amount under the tax card doesn’t depend on income and is set by a decision of the head of the tax office, based on rates published in the Ministry of Finance’s annual notice (for 2026, issued November 17, 2025). The health contribution is fixed at PLN 432.54/month (9% of 100% of the minimum wage, PLN 4,806 in 2026).
For a new sole trader, this method is essentially irrelevant: if you’re registering a business today, the real choice is between general rules, flat tax, and ryczałt.

Changing your tax method
You can change your tax method once a year. A written statement choosing or changing the method (flat tax or ryczałt) must be filed with the head of the tax office by the 20th day of the month following the month you earn your first income of the year, or by year-end if the first income arrives in December. You can also update the method through the CEIDG register.
Does the tax method matter for the PIP 2026 B2B misclassification risk?
An important point that’s often confused: the PIT method you choose (ryczałt, flat tax, or anything else) has no bearing on the risk that the Polish Labour Inspectorate (PIP) will reclassify your B2B contract as an employment relationship under its expanded 2026 powers. That risk depends entirely on the actual conditions of the cooperation (subordination, fixed hours, working under the client’s direction), not on which tax you pay. We cover this in detail in our here.
FAQ
Can I switch tax methods mid-year? No. The method chosen at the start of the tax year applies until year-end (except in your first year of business, if your first income arrives later than January).
Does choosing ryczałt affect my pension contributions? Not directly. ZUS social insurance contributions (pension, disability, etc.) are calculated separately from your PIT method, based on whichever contribution base applies to you (Ulga na Start, preferential ZUS, or full ZUS).
