Before you register a sole proprietorship in Poland, it’s worth calculating how much you’ll actually keep after paying tax and the mandatory health contribution (składka zdrowotna). The difference between tax forms can amount to tens of thousands of złoty a year.

In short and to the point:
  • A sole proprietorship in Poland can choose one of three PIT tax forms: the tax scale (12%/32% of income), flat tax (19% of income), or ryczałt (2-17% of revenue, depending on the type of activity).
  • Besides PIT, every sole proprietor pays a health contribution, and how it’s calculated differs by tax form.
  • Under the tax scale, the 12% rate applies up to PLN 120,000 of annual income, above that, 32%; there’s a tax-free amount of PLN 30,000.
  • Under the flat tax, the rate is fixed at 19% from the very first złoty earned, with no tax-free amount, but simpler bookkeeping.
  • Under ryczałt, the health contribution is fixed and depends on annual revenue: PLN 498.35/month (up to PLN 60,000), PLN 830.58/month (PLN 60,000-300,000), PLN 1,495.04/month (above PLN 300,000).
  • The tax form can be changed once a year, by 20 February, through a CEIDG update.

Three tax forms for a sole proprietorship

A sole proprietorship in Poland can choose, each year, one of three income tax (PIT) forms: the tax scale, flat tax, or ryczałt on revenue. Each form affects not only the amount of tax itself, but also how the mandatory health contribution is calculated, which is paid separately from the tax.

Tax scale

Parameter2026 value
Tax rate12% up to PLN 120,000 of income, 32% above that
Tax-free amountPLN 30,000 per year
Health contribution9% of income, minimum PLN 432.54/month
Expense trackingYes, income = revenue minus expenses

The tax scale works well for people entitled to tax reliefs (e.g. joint filing with a spouse, child tax relief) or with a modest income that fits within the tax-free amount.

Flat tax

The flat tax is a fixed 19% rate on income regardless of its amount, with no tax-free allowance and no option for joint filing with a spouse.

The health contribution is 4.9% of income (minimum PLN 432.54/month), and the paid contribution can be partly added to expenses or deducted from income, up to a limit (roughly PLN 12,900-14,100 per year depending on the source).

This form is usually more favorable than the tax scale for sole proprietors with a stable, high income exceeding the scale’s second threshold (PLN 120,000), since it avoids the 32% rate.

Ryczałt

Ryczałt taxes not income but revenue (without accounting for expenses), at rates from 2% to 17% depending on the type of activity, which for ryczałt purposes is determined by the PKWiU classification of the service, while the PKD code entered in CEIDG only serves as a reference point. The key feature is that the health contribution here is fixed and depends not on the tax amount but on annual revenue:

Annual revenueHealth contribution, PLN/month (2026)
up to PLN 60,000498.35
PLN 60,000-300,000830.58
above PLN 300,0001,495.04

Ryczałt pays off for people with low business costs (e.g. consulting, IT services without equipment purchases), since there’s no need to document expenses to lower the tax base. It’s worth remembering that the ryczałt rate depends on the PKWiU classification of the specific service provided, not on the PKD code entered in CEIDG, so two businesses with the same PKD code can pay different rates if they actually provide different services.

Type of activityRyczałt rate
IT services (programming, IT consulting)12%
Freelance professions (some legal, medical services)17%
Consulting, advisory services15%
Trading goods3%
Construction, specialized works5.5%
Private rental (up to PLN 100,000 revenue)8.5%

Social security (ZUS) contributions besides health insurance

Besides PIT and the health contribution, a sole proprietor must also pay social security (ZUS) contributions: pension, disability, voluntary sickness insurance, accident insurance, and the Labor Fund (if income exceeds a certain threshold). The amount of these contributions doesn’t depend on the chosen tax form, they’re the same whether you settle under the tax scale, flat tax, or ryczałt.

Newly registered entrepreneurs can use three consecutive stages of relief that significantly reduce the cost of running a business at the start:

StageDurationWhat it includes
Ulga na start (start-up relief)6 monthsExemption from social contributions, you only pay the health contribution
Preferential ZUS24 monthsReduced social contributions, calculated from 30% of the minimum wage
Mały ZUS Plus (Small ZUS Plus)36 months (within the last 60 months)Contributions proportional to income, up to an annual revenue limit

After exhausting these reliefs, the entrepreneur moves to full ZUS, calculated from a declared base no lower than 60% of the projected average wage. It’s worth planning your budget in advance, since the transition from preferential ZUS to full ZUS can mean an increase in monthly costs of several hundred złoty.

Payment deadlines and advance payments

Advance income tax payments under the tax scale and flat tax are paid monthly (or quarterly, if the entrepreneur chose this mode and meets the conditions), by the 20th of the month following the settlement period. Under ryczałt, the principle is similar, but the base is revenue for the month or quarter, not income.

The health contribution and social ZUS are paid by the 20th of the month for the previous month (for people running only a sole proprietorship). The annual tax return (PIT-36 for the tax scale, PIT-36L for flat tax, PIT-28 for ryczałt) is filed by 30 April of the following year, except PIT-28, which for some types of revenue has a deadline of the end of February.

Practical calculation examples

The examples below are illustrative and don’t account for additional reliefs, each case should be checked with an accountant.

Programmer, revenue PLN 15,000/month, costs PLN 500/month (low costs, typical for IT services). Under ryczałt at 12%, the tax is calculated from revenue (PLN 15,000), which gives a higher base than the tax scale or flat tax, but the low rate and no need to document expenses often make ryczałt the more favorable choice for this type of activity. Under flat tax, the base would be income (PLN 14,500), taxed at 19%.

B2B consultant, revenue PLN 25,000/month, costs PLN 2,000/month. With annual income above PLN 120,000, the tax scale means taxing part of the income at 32%, which usually makes flat tax (a fixed 19% rate) more favorable, unless the entrepreneur benefits from significant tax reliefs available only under the tax scale.

Freelancer just starting out, revenue PLN 6,000/month, first six months of activity. Using Ulga na start, the entrepreneur pays only the health contribution (no social ZUS), which at low starting revenue significantly improves financial liquidity, regardless of the chosen tax form.

Which form to choose

There’s no universally “best” form, it all depends on your income level, costs, and available reliefs. As a rough guide:

  • Low income, entitled to reliefs, joint filing with a spouse, the tax scale is often more favorable.
  • Stable high income above PLN 120,000 a year, the flat tax is usually more favorable.
  • Low costs, services (IT, consulting, freelance), ryczałt is often more favorable, especially at lower rates (8.5-12%).

The form can be changed every year by 20 February, by filing through CEIDG. It’s worth doing an exact calculation together with an accountant, taking into account your individual revenue and expense structure.

If you’re only planning to register your activity and aren’t yet ready for a full sole proprietorship (for example you’re waiting on residence documents or testing the market), consider working through a business incubator (Employer of Record model), where a third-party company formally issues invoices on your behalf while you receive your pay without having to calculate taxes and ZUS yourself.

Frequently asked questions

Can I change the tax form during the year?

No, a change is only possible once a year, by 20 February, through a CEIDG update. Exceptions exist only for specific cases provided for by law.

Do I need to pay the health contribution if my income in a given month is zero?

Yes, under the tax scale and flat tax, a minimum contribution applies (PLN 432.54/month in 2026) even with zero or negative income. Under ryczałt, the contribution is fixed based on annual revenue, not the result of a specific month.

Which tax form is simplest for a beginner?

Ryczałt is usually the simplest in terms of bookkeeping, since you don’t need to document expenses, just record revenue. The final choice, however, depends on the type of activity and income structure.

Can I combine ryczałt with deducting expenses?

No, ryczałt taxes revenue without accounting for expenses. If you have significant business costs, the tax scale or flat tax is usually more favorable.

Does the ryczałt rate depend on the PKD code entered in CEIDG?

Not directly, the ryczałt rate depends on the actual service provided, classified under PKWiU, not the PKD code. It’s therefore worth consulting an accountant on the correct classification of the service before starting settlements.

What’s the difference between Ulga na start and Mały ZUS Plus?

Ulga na start (first 6 months) fully exempts you from social contributions, you only pay the health contribution. Preferential ZUS (next 24 months) reduces social contributions, calculated from 30% of the minimum wage. Mały ZUS Plus (up to 36 months within 60) ties contributions to actual income, but only up to a set annual revenue limit.

When do I have to pay the first tax advance?

The first advance is due by the 20th of the month following the month (or quarter) in which taxable income or revenue arose, according to the chosen settlement mode.
