NIP (Numer Identyfikacji Podatkowej, Tax Identification Number) is a 10-digit number that identifies a taxpayer in Poland. It’s issued to individuals and to businesses: Polish citizens, foreigners, and companies with foreign capital alike. Here’s when you actually need one, how to get it, how it differs from PESEL, and how to check a counterparty’s NIP before signing a contract.

What NIP is and who needs one

NIP was introduced in 1995 under the Act of October 13, 1995, on the Rules of Records and Identification of Taxpayers and Tax Remitters (Journal of Laws 1995, No. 142, item 702). The number is assigned once, for life. It doesn’t change when you move, change your name, or change your business form, and it stays with a registered company until it’s deregistered.

An individual doesn’t need a NIP if they’re already in the PESEL register and, at the same time:

  • don’t run a business (e.g., a sole proprietorship, JDG);
  • aren’t a VAT payer;
  • don’t pay ZUS contributions for an employed person (e.g., a nanny or housekeeper).

In that case, your PESEL number simply serves as your tax identifier for PIT purposes. The obligation to have a NIP kicks in the moment you start a business, become a VAT payer, or register an employee with ZUS.

Companies registered with the KRS (National Court Register), such as a limited liability company (Sp. z o.o.), joint-stock company (S.A.), limited partnership, or limited joint-stock partnership, must have a NIP from the moment of registration, regardless of who owns them.

How to get a NIP: individuals

An individual can get a NIP in two ways:

1. Automatically, when registering a JDG. If you’re planning to run a sole proprietorship, just file the CEIDG-1 form: online via biznes.gov.pl (with a Trusted Profile/Profil Zaufany or a qualified signature) or in person at your city/municipal office. The NIP is assigned together with your CEIDG entry; if it’s your first NIP ever, it can take up to 3 business days. 2. By filing form NIP-7 at the tax office: this covers people who need a NIP for a reason other than running a JDG (e.g., they’re a VAT payer, they don’t have a PESEL number, or they employ a nanny or housekeeper and pay ZUS/NFZ contributions for that person).

The NIP-7 form can be filed in person at the tax office (Urząd Skarbowy) covering your place of residence, by mail (with a notarized signature), or electronically via the e-Deklaracje system (requires a qualified electronic signature). Getting a NIP this way is free. A 17 PLN stamp duty applies only if you act through an authorized representative (pełnomocnik). The NIP should be issued within 3 days of a complete application.

Important: one individual can hold only one NIP, regardless of whether it was assigned via CEIDG-1 or NIP-7. The tax office will refuse to issue a new number if you already have an active one.

How to get a NIP: companies

Companies entered into the KRS have 21 days from receiving confirmation of their court registration to file form NIP-8 with the tax office. This form covers additional data not required for the KRS entry itself, such as the business address, bank account numbers, accountant details, and information about co-founders. Once it’s filed, the tax office forwards the relevant data to the statistical office (for the REGON number) and to ZUS on your behalf.

If any of the data reported on NIP-8 changes later (e.g., a new accountant or bank account), you have 7 days to notify the tax office. The same rule applies to individuals registered via NIP-7. Failing to do this is a tax offense (wykroczenie skarbowe) and carries a financial penalty.

NIP vs. PESEL: the key differences

This is a common source of confusion, especially for foreigners starting a business in Poland:

PESELNIP
Digits1110
Purposepopulation register, civil/administrative matters, residence registration, ZUS as an insured persontax identification: VAT, PIT/CIT for entrepreneurs, ZUS contribution payer
Who needs itevery registered resident of Poland (citizen or foreigner after registering residence)only entities running a business, VAT payers, or contribution payers for other people
Mandatory without a businessyes, it’s your basic identifierno, unless you run a business or are a VAT payer

In practice: if you don’t run a business and aren’t a VAT payer, your PESEL is your tax identifier for PIT purposes. You don’t need to apply for a NIP at all. Registering a JDG doesn’t make your PESEL disappear, but for business purposes (invoices, VAT, dealing with the tax office) you switch to using your NIP.

How to verify a counterparty’s NIP: the VAT taxpayers’ whitelist

Before starting a cooperation with a new counterparty, especially if you’re planning a payment above PLN 15,000, it’s worth checking them against the Register of VAT Taxpayers, commonly known as the VAT whitelist (Wykaz Podatników VAT / biała lista). It’s maintained by the Head of the National Revenue Administration (KAS) and is available free of charge at podatki.gov.pl.

The search tool lets you look up a counterparty by any one of four identifiers:

  • NIP number;
  • REGON number;
  • bank account number;
  • company name (or full name for individuals running a JDG registered with CEIDG).

The result tells you whether the counterparty is an active VAT taxpayer, whether their registration was ever revoked or restored, and lists the bank accounts they’ve reported to the tax office. The register is updated once a day, and every search generates a unique confirmation you can print and keep as proof of due diligence.

Why it matters: if you pay a counterparty to an account that isn’t on the whitelist for a payment over PLN 15,000, you can’t count that expense as a deductible business cost, and in some transactions you become jointly liable for the counterparty’s VAT.

FAQ

Does my NIP change if I move to a different city? No. NIP is assigned once and stays the same regardless of a change of address, name, or business form.

Can I use both PESEL and NIP at the same time when I run a JDG? Yes, PESEL remains your personal identifier (e.g., with ZUS as an insured person), while you use NIP for business accounting, invoices, and dealings with the tax office as an entrepreneur.

Is checking a counterparty on the whitelist legally required? There’s no blanket legal obligation to check every counterparty, but for payments above PLN 15,000 to an account not listed on the whitelist, you risk tax penalties (losing the deductible cost, joint VAT liability). In practice, verification is strongly recommended.
